Atlanta City Council Moves to Approve Settlement in Bicycle Accident Lawsuit

The front tire of the plaintiff’s bike struck a pothole, which threw him over the handlebars and caused him to land face first in the street. Despite the fact the plaintiff was wearing a bicycle helmet at the time, he suffered a number of catastrophic injuries, including brain bleeding, facial fractures, and spinal cord fractures, according to his subsequent personal injury lawsuit.
The plaintiff’s lawsuit initially sought $11 million in damages against the City of Atlanta. The plaintiff alleged the City was liable for his accident because it failed to repair the pothole in question, or warn bicyclists of the danger, despite receiving numerous complaints from local residents, including reports of prior bicycle accidents that led to serious injuries.
The City Attorney negotiated the $999,999.99 settlement after determining it would likely cost more for the City to defend against the lawsuit in court. According to CBS News, the settlement “will come from the city’s General Fund and be classified as a litigation expense.” In exchange for the payment, the plaintiff and his wife will dismiss their pending personal injury lawsuit.
